Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Poucher mobile applications and website (the “Service”) operated by Poucher (“we,” “our,” or “us”).
By creating an account or using the Service you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.
If you are using the Service on behalf of an organisation, you represent and warrant that you are authorised to bind that organisation to these Terms.
Description of Service
Poucher is a digital adventure journal that allows users to document, photograph, organise, and optionally share their treasure-hunting finds — including metal detecting, arrowhead hunting, bottle digging, rockhounding, and mudlarking discoveries.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
Account Registration & Security
To access certain features you must create an account. You agree to provide accurate and complete information during registration and to keep that information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@getpoucher.com if you suspect unauthorised use of your account.
You may not share your account with any other person or use another user’s account without permission.
Acceptable Use
You agree not to use the Service to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Upload content that infringes any third party’s intellectual property rights
- Impersonate any person or entity, or falsely state your affiliation with any person or entity
- Scrape, crawl, or systematically collect data from the Service without our express written permission
- Use the Service in any way that could damage, disable, or overburden our infrastructure
- Attempt to gain unauthorised access to any part of the Service or any account, system, or network
- Use the Service for any commercial purpose without our prior written consent
We reserve the right to suspend or terminate accounts that violate these rules.
Your Content
Ownership
You retain full ownership of the content you submit to the Service (“Your Content”), including photos, text, and location data.
Licence to Poucher
By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, display, and distribute Your Content solely for the purpose of operating and promoting the Service. This licence ends when you delete Your Content or your account.
Public Content
If you mark a hunt or treasure as public, you grant other users of the Service and visitors to our website the right to view it. You may change the visibility setting at any time.
Your Representations
You represent and warrant that you have all rights necessary to submit Your Content and that Your Content does not violate any law or these Terms.
Intellectual Property
The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Poucher and its licensors. Our trademarks, logos, and trade dress may not be used in connection with any product or service without our prior written consent.
Nothing in these Terms grants you a right or licence to use any trademark, logo, or other proprietary information of Poucher.
Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy so you understand our practices.
Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POUCHER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Indemnification
You agree to defend, indemnify, and hold harmless Poucher and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the Service, Your Content, or your violation of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page and may notify you via email.
Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service.
